1. Preamble

These Terms of Sale are concluded between, on the one hand, the SCEV Champagne Jean-François Launay, a company with share capital of € 7,622.45, registered at Reims’ Register of Companies and Societies under number 390 415 529, whose head office is located at rue de Venteuil, Arty – 51480 Venteuil ; and on the other hand any person, having reached the minimum legal age required to buy alcohol (18 years old in France), or any society wishing to make a purchase via the online store of Champagne Jean-François Launay : www.champagne-jean-francois-launay.fr/en hereinafter referred to, the Buyer or the Customer. These Terms of Sale describe the rules applicable for the sale of products which are distributed by Champagne Jean-François Launay within the official online store www.champagne-jean-francois-launay.fr. They constitute the entirety of the rights and obligations of the parties, no other condition being able to fit into them. They will apply throughout the duration of the online distribution of the products.

2. Protection of minors

3. Geographical area

The online sale of the products presented on the site www.champagne-jean-francois-launay.fr/ is only possible for buyers wishing to make deliveries in mainland France and Corsica only. 4. Order taking & confirmation

The customer who wishes to purchase products through the online store must carry out the following steps:

  • Choose the products: complete the online order form by clicking on the desired products, entering the desired quantity and clicking on “add to cart”.
  • Confirm cart: follow the steps of the order and its validation by clicking on the button “confirm order” of the ‘cart page’.
  • Create an account by filling the identification form on which it will indicate all the mandatory fields (name, first name, delivery address, billing address, telephone, email etc.)
  • Accept Terms of Sale by checking the box provided for this purpose after having read them. It is not possible to validate an order without the manifestation of this full and unreserved acceptance of the terms of sale specified in the context of the online store. This ticked box thus constitutes recognition on the part of the purchaser of having perfect knowledge of them.
  • Validate the order after checking it.
  • Proceed to payment for the online order.

Champagne Jean-François Launay will acknowledge receipt of the order by displaying a confirmation message which will mention in particular the order number (simultaneous sending of a summary email of the order to the customer). Orders validated on www.champagne-jean-francois-launay.fr/ contractually bind the customer and Champagne Jean-François Launay by signing and accepting the terms of the commercial transaction carried out. Champagne Jean-François Launay however reserves the right to suspend or cancel any abnormally high order or any order which does not contain all of the information necessary for the delivery of the products. In all cases, the customer will be informed by Champagne Jean-François Launay.

5. Online products & prices

Products sold on the Champagne Jean-François Launay online store are offered within the limits of available stocks. Prices appear in euros including all taxes, taking into account the VAT applicable on the day of the order. Any change in the rate may be reflected in the products prices. Champagne Jean-François Launay reserves the right to modify its prices at any time and without notice, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Buyer. Prices indicated on the online store do not include shipping costs. These are indicated during the process of order validation.

6. Payment

Online payment is due when ordering, and can be done exclusively with credit card (CB, VISA and Eurocard / Mastercard) at the total price (taxes, order preparation and delivery costs included) and in Euros. Champagne Jean-François Launay implements all means to ensure the confidentiality and security of the data transmitted on www.champagne-jean-francois-launay.fr/boutique. Online payment is made through the secure payment system STRIPE (www.stripe.com). As an expert in payment security, STRIPE ensures that sensitive data is transmitted and stored according to the highest security and quality standards. To proceed with the payment of the buyer’s order, STRIPE will ask for the following information: type of payment card (Visa, Eurocard, Mastercard), number of the payment card, its expiration date and its possible visual cryptogram. The transaction is immediately debited from the Customer’s bank card after verification of its data, upon receipt of the debit authorization from the company issuing the bank card used by the Customer. In accordance with Article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By providing the information relating to his bank card, the Customer authorizes the Seller to debit his bank card for the total price tax included. In the event that the debit of the total price tax included is impossible, the Online Sale will be automatically canceled.

Your bank details are automatically encrypted and cannot be intercepted. Our site does not receive any information about your bank card. 

7. Shipping

7.1 Shipping method

Delivery is by carrier to the address indicated by the customer when confirming his order. The Customer chooses a Delivery address necessarily located in metropolitan French territory or in Corsica, under penalty of refusal of the Order. The Customer is solely responsible for a defect or a delay in Delivery due to a lack of indication or an error in entering information during the Order. All costs incurred for the reshipment of the Order, due to an error in entering information by the Customer when placing the Order, will be the sole responsibility of the buyer.

7.2 Shipping fees

Shipping costs are calculated according to the order. Shipping Costs are indicated to the buyer before the order validation and are to be paid by the buyer.

7.3 Delivery delay

The Delivery Times run from the date of Confirmation of the Order by the Seller. They generally vary between 5 to 7 working days, and may vary depending on the availability of the products ordered, and take into account the preparation time of your order. The customer is aware that these deadlines can significantly increase during the end of the year holiday season due to numerous orders. Delivery means the delivery of the goods by the Seller to the Customer, which takes place as soon as the said goods are taken over by the carrier.

7.4 Receipt of order

It is the customer’s responsibility to check the contents of the package at the time of delivery and to formulate any reservations – or even to refuse the package – on the receipt slip before signing. In the event of reservations, even if they are clearly, precisely and completely indicated, they must be the subject, within three days of delivery, of a written confirmation by registered letter with acknowledgment of receipt to the Carrier, in accordance with Article L 133-3 of the New Commercial Code. In case of refusal of the package, the customer may, if he wishes, ask the Carrier to return the package, which must be accompanied by a “report of theft”, of which the Customer will keep a copy. Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within 48 hours of the date of Delivery of the Goods. The Customer must also send a copy of this letter to the Seller. Failure to make a complaint within the aforementioned period and in accordance with the aforementioned terms extinguishes any action against the carrier and the Seller in accordance with Article L. 133-3 of the Commercial Code. The Customer must ensure that the Goods delivered to him correspond to the Order.

In the event of non-compliance of the Goods in kind or in quality with the specifications mentioned in the Delivery slip, the Customer must inform Champagne Jean-François Launay by email or mail with acknowledgment of receipt and return all the goods received in their original packaging at the following address: Champagne Jean-François Launay, rue de Venteuil, Arty – 51480 Venteuil. The shipping costs of non-compliant package will be the responsibility of Champagne Jean-François Launay. Champagne Jean-François Launay assumes no responsibility for damages whatever the origin. The responsibility of Champagne Jean-François Launay can not be engaged after the assumption of responsibility by the customer in the event of defect noted on the goods attributable to bad storage conditions.

7.5 Late delivery

In the event of late Delivery, the Order is not canceled. The Seller informs the Customer by email that the Delivery will be delayed. In the event that the Order has not yet been shipped upon receipt by the Seller of the Customer’s cancellation notice, the Delivery is blocked and the Customer is refunded any sums possibly debited within thirty days following receipt of the cancellation notice. In the event that the Order has already been shipped upon receipt by the Seller of the Customer’s cancellation notice, the Customer can no longer cancel the order.

7.6 Sold out

The Order is processed by the Seller within a maximum of five working days, excluding delivery times. In the event of an out of stock of a good ordered, Champagne Jean-François Launay will contact the Customer, by e-mail, by post or by telephone, as soon as possible, in order to inform him and to agree with him:

  • To postpone the Delivery while awaiting the replenishment of this good, when possible,
  • To replace the good with another equivalent in quality and price,
  • To cancel the order and refund the price paid.

8. Major Force

Champagne Jean-François Launay is entitled to cancel any order, and is in particular released from any obligation, in the event of major force or failure to meet the deadlines of our own suppliers or prime contractors, natural disasters preventing, according to forecasts, either manufacturing or delivery of supplies. The following are considered to be major force: strikes, fires, floods, equipment or tool accidents, interruption of transport or any other changes outside and within the company preventing the normal and planned execution of our sales.

9. Modification, cancellation, withdrawal

9.1 Modification / cancellation

Orders are firm, final and not subject to modification or cancellation, except under the conditions set out in Article 9.2 hereof.

9.2 Withdrawal

The Customer has a right of withdrawal which he can exercise within 14 calendar days of the date of receipt or withdrawal of the Order. In the event that this period expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. The Customer who wishes to exercise his right of withdrawal must return the Goods or Products within the aforementioned period, in their original packaging, complete, new, it being specified that the return costs are to be paid by the Customer.

10. Disputes

Sales made by Champagne Jean-Francois Launay are all subject to French law. Any dispute that could not have been settled amicably will fall under the exclusive jurisdiction of Reims Commercial Court.
